Template VCAT submissions

The template VCAT submissions are designed for you to ‘mix and match’ depending on what issues are relevant to your matter. The way that the submissions fit together is modular. The general template is the base, then you can use the additional templates to build your submissions. 

For all eviction matters you will need the following templates: 

  • General template (template 1) 
  • Jurisdiction / validity of notice (template 3) 
  • NTV-specific content (template 4) 
  • Reasonable and proportionate test (template 5) 

Optional:

  • Review application (template 2) 
  • Compliance or other order for behaviour-related NTVs (template 6)

Use these templates alongside the guidance provided in your intake memorandum and the housing and tenancy section.

   We will continue to update our templates and upload new templates so always return to this page to download your templates. Avoid saving templates to your computer for future use.

1. General base template

This is the base template that all other template content should slot into. You should use it for all submissions.

2. Review applications

Use this template if your client is making a review application under s 120 of the VCAT Act. 

3. Jurisdiction / validity of notices to vacate

This template addresses submissions on the validity of notices to vacate as well as jurisdictional points. Use it for all submissions. 

4. Notice to vacate specific content

These templates address specific issues in a notice to vacate. Pick the relevant template based on your client’s notice to vacate. 

5. Reasonable and proportionate test

This template addresses submissions reasonable and proportionate test. You should use it for all submissions. 

6. Compliance or other order for behaviour-related NTVs

This template addresses submissions for behaviour-related NTVs where a compliance order or other order more appropriate than possession order may be made.
